European General Terms and Conditions of use of railway infrastructure

The E-GTC-I shall apply to all contracts of use of railway infrastructure for the purpose of transports by rail. The scope of application shall be international or international and domestic transports by rail.

This document provides for basic contractual conditions of use of railway infrastructure, without prejudice to additional or specific provisions agreed by the parties.

The provisions of these E-GTC-I have been drawn up without prejudice to prevailing mandatory international or national law. By signing the contract of use, the parties acknowledge and accept the contents of the E-GTC-I.

The E-GTC-I shall apply to all railway undertakings (or international groupings of railway undertakings railway undertakings) and infrastructure managers. Unless otherwise provided, the provisions of the E-GTC-I concerning railway undertakings shall also apply to international groupings of railway undertakings.

Infrastructure managers infrastructure managers shall apply the GTC to all the railway undertakings using their infrastructure without discrimination. For implementation, the E-GTC-I shall apply without prejudice to the competenc-es attributed to other bodies, mainly capacity allocation or charging bodies.

For questions of interpretation due to the different language versions of the E-GTC-I the English version shall prevail.

This document has been drawn up to deal with the contractual relationship between the infrastructure manager and a railway undertaking. The contractual relationship between the infrastructure manager and an “applicant” (i.e. a person who is not a railway undertaking or an international grouping of railway undertakings - Directive 2012/34/EU1) has not been studied or taken into account at this stage.
